These Terms and Conditions govern your use of the website located at sanbenitoconcretepolishingandepoxyflooring.com and your relationship with San Benito Concrete Polishing & Epoxy Flooring ("we," "us," or "our") as a customer or prospective customer. By using our website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.
By accessing our website, submitting a contact or estimate form, or entering into any service agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. We reserve the right to update these terms at any time. Continued use of our website or services after an update constitutes your acceptance of the revised terms.
San Benito Concrete Polishing & Epoxy Flooring provides residential and commercial concrete flooring services in San Benito, TX and surrounding communities in the Rio Grande Valley. Our services include, but are not limited to, epoxy floor coatings, polyaspartic coatings, polished concrete, stained concrete, garage floor coatings, terrazzo, pool deck coatings, concrete resurfacing, concrete sealing, and related surface preparation and removal work.
All services are provided subject to a written estimate or service agreement. We reserve the right to decline any project at our discretion.
Estimates provided by San Benito Concrete Polishing & Epoxy Flooring are based on information available at the time of the on-site assessment and reflect the scope of work as described. Estimates are valid for 30 days from the date of issue.
Final pricing may be subject to change if conditions discovered during the work differ materially from what was observable at the time of the estimate - for example, hidden moisture damage, prior coatings that require removal, or structural issues not visible during the initial assessment. We will notify you and obtain your approval before proceeding with any work that would increase the cost beyond the original estimate.
We do not charge for on-site estimates. Submitting an estimate request does not create a binding obligation on either party.
Once a project is confirmed, we will coordinate a start date with you. It is your responsibility to ensure the work area is clear and accessible on the agreed start date. This includes removing all vehicles, equipment, furniture, and stored items from the floor area before our crew arrives.
If the area is not ready on the scheduled date, we may need to reschedule, which could result in a delay. Repeated or last-minute access issues may result in a rescheduling fee.
You may cancel a scheduled project by contacting us at least 48 hours before the confirmed start date at no charge. Cancellations with less than 48 hours notice may be subject to a cancellation fee to cover materials ordered and crew scheduling costs already incurred.
We reserve the right to postpone or cancel a scheduled project due to weather conditions, supply availability, or other circumstances outside our reasonable control. In such cases, we will contact you as soon as possible to reschedule at no charge to you.
Payment terms will be outlined in your written estimate or service agreement. In most cases, a deposit may be required at the time of project confirmation, with the balance due upon completion of the work.
Payment is accepted by methods agreed upon at the time of estimate. Final payment is due on the day the project is completed unless otherwise specified in writing. Invoices not paid within 30 days of the due date may be subject to a late payment fee.
If payment is not received, we reserve the right to pursue collection through all available legal remedies, including the recovery of reasonable attorney fees and court costs.
We stand behind the quality of our workmanship. Any warranty on labor or materials will be described in your written service agreement. Where no specific warranty is stated, we provide a reasonable workmanship standard consistent with industry norms.
Our warranty does not cover damage caused by misuse, failure to follow care instructions, flooding or water intrusion beyond normal conditions, structural movement in the underlying slab, or modifications made to the floor by parties other than San Benito Concrete Polishing & Epoxy Flooring.
Third-party products and materials are subject to the manufacturer's warranty terms. We do not extend or modify manufacturer warranties beyond what the manufacturer provides.
To the fullest extent permitted by applicable law, San Benito Concrete Polishing & Epoxy Flooring shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services we provide or your use of our website. This includes, without limitation, loss of income, loss of business opportunity, or property damage beyond the direct scope of our work.
Our total liability to you for any claim arising out of our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.
You agree to use our website for lawful purposes only. You may not use our site to distribute malware, attempt unauthorized access to our systems, submit false or misleading information, or engage in any activity that interferes with the operation of our website or the experience of other visitors.

If the dispute cannot be resolved through direct discussion, the parties agree to attempt non-binding mediation before pursuing any other legal remedy. Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these terms or our services shall be brought in a court of competent jurisdiction in Texas.
